Restriction on activities in connection with collective investment schemes
Subject to section 29, a licensee shall not engage by way of business in any restricted activity in connection with a collective investment scheme unless –
(a) the scheme is an authorized collective investment scheme of a specified class; and
(b) he carries on that activity in accordance with –
(ⅰ) any conditions imposed under section 9 in respect of that scheme; and
(ⅱ) any rules and regulations applicable to an authorized collective investment scheme of that class.

Section 10
Avoidance of exclusion clause
Any provision of an authorized collective investment scheme which would have the effect of exempting any person carrying on a restricted activity in relation to the scheme from liability for failure to exercise due care and diligence in discharge of his functions in respect of the scheme, is void to that extent.
